THE CENTRAL BODY
Article–12:
The Central Body shall consist of the Central President, the Executive Council, and the Secretariat.
THE CENTRAL PRESIDENT
Article–13:
The Central President shall be elected by the members of this Organization through direct voting for a term of one year.
Article–14:
If, for any reason, the post of the Central President becomes permanently vacant, the Executive Council shall temporarily elect a Central President from among its members and shall immediately arrange for an election to the post of Central President for the remainder of the session.
If the Central President is required to take temporary leave, he may, in consultation with the Executive Council, appoint an Acting President from among the members of the Executive Council for a period not exceeding three months.
Article–15:
The Central President or the Acting President, whether elected or appointed, shall take the oath of office as prescribed in the Appendix of this Constitution at the Members’ Conference or at a session of the Executive Council before assuming office.
Article–16:
The principal duty and responsibility of the Central President shall be to achieve the aims and objectives of this Organization, to administer its affairs, to implement its programmes, and to establish and maintain the highest standard of discipline within the Organization.
Article–17:
The Central President shall generally function in consultation with the Executive Council. However, he shall not be bound by this provision when it becomes necessary to conduct day-to-day affairs or to take urgent and temporary measures on matters not decided by the Executive Council.
Article–18:
The Central President, either directly or through authorized workers, shall exercise the powers vested in him under various Articles of this Constitution.
THE EXECUTIVE COUNCIL
Article–19:
The Executive Council shall be formed for a period of one year with representatives elected by direct votes of the members in a ratio determined by the closing general session of the Executive Council. The President may, if he deems it necessary, nominate members, not numbering more than one-third of the elected members, and members from among the ex-members of the Executive Council, not numbering more than two, in consultation with the Executive Council. The Central President shall be the Chairman, and the Secretary General shall be the ex-officio member of the Executive Council.
Article–20:
The members of the Executive Council shall take the oath under the direction of the Central President.
Article–21:
If a seat of the elected members of the Executive Council becomes vacant, the vacancy shall be filled within three months.
Article–22:
The collective and individual duties and responsibilities of the members of the Executive Council shall be to supervise themselves, supervise the Central President, oversee the practice of Islamic principles in the Organization, supervise and monitor the implementation of the programs of the Organization, supervise the pursuit of the Constitution, eliminate any defects in the Organization, chalk out the basic plans of the integrated activities of the Organization, advise the Central President, express views without hesitation, and regularly attend the sessions of the Executive Council or send opinions through correspondence if unable to attend.
Article–23:
There shall be three general sessions of the Executive Council in a year. The session of the Executive Council must be convened if the Central President deems it necessary, or on the request of one-fifth of the members of the Executive Council, or one-tenth of the total members of the Organization, submitted in writing to the Central President. The Executive Council shall be summoned within a period of one month from the date of requisition.
Article–24:
The presence of one-third of the total members of the Executive Council shall constitute the quorum for a meeting. However, if any meeting is adjourned for lack of quorum, no quorum shall be required for the next meeting. Each decision of the Executive Council shall be taken based on the opinions of the majority of the members present.
Article–25:
In case of a difference of opinion between the Central President and the Executive Council, and if they cannot agree on each other’s opinion, the decision of the majority of the members of the Organization shall be conclusive.
THE SECRETARIAT
Article–26:
The Central President shall form, in consultation with the Executive Council, the Secretariat consisting of the General Secretary and the required number of departmental secretaries. The Central President may, in consultation with the Executive Council, partially or fully reconstitute the Secretariat if he deems it necessary.
Article–27:
The Secretary General shall be responsible for the proper management of the departmental work of the Secretariat. His responsibility shall include helping and advising the subordinate organizations and workers of the Organization, and keeping the Central President informed about all affairs.
Article–28:
The responsibility and duty of the Secretariat shall be to provide full cooperation to the Central President in the discharge of their responsibilities and duties. The Secretariat shall remain accountable to the Central President for its functions.
OTHER TIERS
Article–29:
The Central President may, in consultation with the Executive Council, evolve and establish other tiers and determine their administrative system according to needs and circumstances.
BRANCH ORGANIZATION
Article–30:
The Central President is authorized to form member branches, associate branches, and district branches in accordance with procedures approved by the Executive Council.
Article–31:
The president of a member branch shall be elected by direct votes of the members for a period of one year and the president of an associate branch shall be elected by direct votes of the members and the associates for a period of one year. The executive council shall nominate the president of the district branches for a period of one year. Under unavoidable circumstances, on the direction of the Central President, branch president election or nomination may be conducted at any time of the year.
Article–32:
The duties and responsibilities of a branch or organization are to materialize the programs of the Organization in the light of the central plan and to actualize the directives of the Central President.
ELECTIONS
Article–33:
An election commission shall conduct the election of the Central President. The Central President shall constitute the election commission in consultation with the executive council, consisting of a chief election commissioner and two assistant election commissioners. The executive council shall determine the election procedure of all tiers of the Organization.
Article–34:
While electing the President or a member of the Executive Council, any responsible person of this Organization, a person’s adherence to the dictates of Allak S.W. and His Prophet’s peace be upon him, fear of Allah, proper understanding of ideology, organizational wisdom, capability of ensuring discipline, mental equilibrium, innovation, analytical ability, steadfastness, determination, trustworthiness, and goodwill towards the cause must be kept in view.
Article–35:
Direct or indirect canvassing shall be allowed in an election of this Organization. Grouping and group activities shall not be permissible in support of or against any person. However, it shall not be deemed to fall under the definition of canvassing. The person securing the highest number of votes shall be declared elected.
Fund/BAITUL MAAL
Article–36:
There shall be a Baitul Maal of the Organization. The contribution of the workers and the well-wishers, the sale proceeds of the publication of the Organization, and the money from other Shariah-approved sectors shall be the sources of income of Baitul Maal.
Article–37:
The respective president shall spend the money of Baitul Maal for the materialization of the programs of the Organization and for other organizational activities.
Article–38:
Money from the other Shariah-approved sectors could be collected only with the prior permission of the Central President, and the account of the money obtained from these sectors shall be maintained separately. This money shall only be spent under the specific heads specified by Shariah.
Article–39:
The subordinate organization shall regularly deposit a fixed amount of money to the Baitul Maal of the upper organization.
Article–40:
The Central President shall remain responsible to the executive council concerning the income and expenditure of the Baitul Maal and supervise and control the Baitul Maal of the subordinate organization. The Central President shall constitute an audit committee in consultation with the executive council. The audit committee shall audit the Central and branch Baitul Maal at least once a year. The audit report shall be presented to the executive council meeting.
DISMISSAL
Article–41:
The Central President may be removed from his post if he intentionally violates any clear injunctions of Shariah or if his conduct is likely to cause serious harm to the Organization.
Article–42:
If the majority of the members of the executive council pass a “no confidence” motion against the Central President, the whole affair is to be presented to the members of the Organization within one month. If the majority passes the motion of “no confidence,” the Central President shall be removed from office. The executive council shall be dissolved, and a new election shall take place if the majority of the members of the Organization vote in favor of the President.
Article–43:
If a “no confidence” motion against the Central President is to be removed from among the members, it shall be delivered to the executive council in writing, signed by one-tenth of the members. After the motion is to be put to a session of the executive council within one month. If the majority of the members of the executive council pass that “no confidence” motion against the Central President, the whole affair is to be presented to the members within one month. The Central President shall vacate his office if the majority of the members vote in favor of the “no confidence” motion. The executive council shall be dissolved, and a new election shall take place if the majority of the members vote against the “no confidence” motion.
Article–44:
The Central President shall take the opinion of the members of the Organization if he deems it necessary to alternate the executive council or any elected member of the executive council. If the majority of the members pass their verdict in favor of his opinion, then the executive council or the aforesaid elected member of the executive council shall be dismissed. But the Central President shall have to submit his resignation in a session of the executive council, summoned within one month, if the majority of the members oppose his opinion as regards the collectively dismissed members of the executive council.
Article–45:
A member of the executive council shall lose his membership when he ceases to remain a member of the Organization or remains absent in two successive sessions of the executive council without any acceptable grounds or resigns his membership from the executive council, and the Central President accepts it, or if the majority of the members who elected him express “no confidence” against him.
Article–46:
The Central President may suspend any branch if he deems it necessary, but he must consult with the executive council if he intends to totally dissolve a branch.
AMENDMENT OF THE CONSTITUTION
Article–47:
Any amendment of this Constitution may be adopted directly in a member conference by the majority vote of all the members. But the notice of the aforesaid amendment must be delivered to the Central President two weeks prior to the member conference. Any amendment of this Constitution may also be adopted by the majority votes of the members of the executive council. But any such amendment shall be approved by a majority vote of all the members within two months of its adoption.
Article–48:
The decision of the executive council shall be conclusive regarding the interpretation of any Article or matter of this Constitution.
MISCELLANEOUS
Article–49:
The organizational year of this Organization shall commence from 1st January.
Article–50:
A brother’s forum shall be formed with the students related to this Organization after the completion of their student life.
